What if a Bailiff can't gain entry

If it’s a County Court Judgement (CCJ)

The warrant is returned to the Court and now your creditor has to decide whether or not it is worth carrying on with the action. It’s a costly process. They may decide it is not cost effective. This would be a good time to talk to them, to come to an arrangement, negotiate a reduction in the original debt. Then the CCJ can be marked satisfied. There are people who can help you with this. A good first step would be to speak to the Citizens Advice Bureau.

If it's a Council Tax Debt

The warrant is returned to the Council. They will continue to pursue the debt by either:

  • Attachment of Earnings;
  • A Payment arrangement; or
  • Committal proceedings. This will involve a Means Tested enquiry to see how much you can pay and/or whether you should be imprisoned.
