How We Can Help

Most complaints relate to private Bailiffs enforcing Council Tax arrears.
Excess charges raised can go into hundreds of pounds, even thousands. Typical example from Citizens Advice.
Council Tax arrears of £166.09 resulted in Equita adding costs of £454. These costs were reduced eventually to the correct, legal amount of £85.
A recent survey conducted by Citizens Advice found:

  • 35% reported Bailiffs misrepresenting powers of entry.
  • 24% reported Bailiffs threatening clients with imprisonment.
  • 37% reported Bailiffs overcharging clients with their fees.
  • 61% reported Bailiffs are harassing or intimidating clients.
  • 74% reported problems attempting to negotiate with Bailiffs.
  • 52% reported vulnerable clients being pressurised.
  • 42% reported Bailiffs failing to exercise discretion in a vulnerable situation.

The most common complaint concerning excessive charging relates to:

  • Alleged visits not made.
  • Levy fees where no levy has been raised.
  • Walking Possessions fee where no Walking Possession Agreement has been signed.
  • Attendance to Remove fees or van fees where there is no valid levy.

We will provide you with a means to:

  • Stop the Bailiff by suspending the warrant.
  • Identify illegal fee charging
  • Deny entry to the Bailiff.
  • Identify an invalid Walking Possession Order.
  • Stop the Bailiff levying on 3rd party goods.
  • Stop the Bailiff levying on exempt goods.
  • Reclaim your vehicle.
  • Report the Bailiff to the Police.
  • Report the Bailiff to the Local Authority.
  • Report the Council to the Local Government Ombudsman (LGO). The Council is responsible for their Bailiffs.
  • Report the Police to IPCC if necessary.
  • File a complaint to the Certifying Court.
  • Reclaim over-charged fees.
  • Make the Bailiff pay in as many ways as possible; and
  • Get back control.

Within the complaints correspondence you will be provided with, there is a demand to have illegal and disproportionate fees returned and for the Bailiff to be censured for inappropriate behaviour. This may result in the Bailiff’s licence being revoked. No licence, no job - just one of the ways to hit the Bailiff in the pocket. The Bailiff will be less intimidating, less inclined to misrepresent his powers, less inclined to break the law, if you have the know-how to fight back.

With our help, you can get money back from :

  • The Bailiff firm.
  • The Certifying Court.
  • The Council.

The first letter you send to the Bailiff firm and give to the Bailiff by hand (through the letterbox) will make it very clear to them that you know the law and you will use it against them.

Now they stand to lose.
That will change the way they behave.
Bullies like easy targets. Don’t be that target.
